Terms of Use

The short version: Keptcase is a subscription app. You get 7 days free, then it's $4.99 a month or $39.99 a year. If you stop paying, your collection stays on your phone — you can still browse it and export it to CSV — but adding, scanning, values, backup and the rest stop working until you subscribe again.

The values Keptcase shows are estimates from public market data. They are not a professional appraisal.

1. Agreement

These Terms of Use are an agreement between you and Pagani Enterprises LLC ("we", "us"), covering the Keptcase iOS app, the keptcase.app website, and published shelf pages (together, the "Service"). By downloading or using Keptcase you accept these terms. If you don't accept them, don't use the Service.

You must be at least 13 years old to use Keptcase.

Your collection is yours and it stays on your device. When a subscription lapses or is cancelled, Keptcase enters a read-only state:

We do not delete your local collection because a subscription ended. Resubscribing restores full access to the data already on your device.

4. Your licence to use Keptcase

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Keptcase on Apple devices you own or control, in line with the App Store Terms of Service and these terms. You may not copy, modify, reverse-engineer, resell, sublicense, or attempt to extract source code from the Service, except where that restriction is prohibited by law. We keep all rights not expressly granted, including in the Keptcase name, logo, and software.

5. Your collection and your content

Everything you enter — items, ratings, notes, diary entries, photos — belongs to you. We claim no ownership of it. You are responsible for having the right to any photo or text you add.

If you choose to publish a shelf, you are making that content publicly accessible to anyone with the link, and you grant us the limited right to host and display it for that purpose. Publishing is opt-in and you can unpublish at any time. We may remove a published shelf that breaches section 6, and we provide a reporting mechanism for shelves that do.

6. Acceptable use

Don't use Keptcase to break the law, infringe anyone's rights, or publish content that is unlawful, hateful, harassing, or sexually explicit. Don't attempt to disrupt or overload the Service or the third-party providers behind it, scrape or bulk-extract data from it, or use it to build a competing dataset. Don't misrepresent someone else's collection as your own on a published shelf.

7. Estimated values are estimates

Keptcase shows estimated market values drawn from public and licensed third-party sources, including recent sale prices and current listings. These estimates are provided for your own reference and convenience.

They are not a professional appraisal, an offer, or a guarantee of what any item will sell for. Prices for physical media move constantly and depend heavily on condition, edition, and packaging, which we cannot verify. The insurance and estate export is a formatted inventory of the information you entered together with those estimates — it is a record you can hand to someone, not a valuation certificate. Before relying on any figure for insurance, tax, probate, sale, or any other financial or legal purpose, have it confirmed by a qualified appraiser or your insurer. We are not responsible for decisions made on the basis of an estimate.

8. Information from other sources

Keptcase fills in covers, credits, tracklists, descriptions, and prices from third-party providers including TMDB, IGDB, Discogs, PriceCharting, eBay, Open Library, MusicBrainz, and the iTunes Search API. That information belongs to those providers and is subject to their terms. We don't control it and can't guarantee it is accurate, complete, or available — a provider may change or withdraw its data at any time, which may change what Keptcase can show. Attribution for these sources appears in the app under Settings → Acknowledgements.

This product uses the TMDB API but is not endorsed or certified by TMDB.

9. Availability and changes

We work to keep Keptcase running, but we don't promise uninterrupted or error-free service. Features may be added, changed, or removed as the app develops, and cloud features depend on services we don't operate. Where a change materially reduces what a paid subscription provides, you can cancel and stop future renewals.

10. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or the cost of substitute services, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

Keep your own backups. Cloud Backup is a convenience, not a guarantee. CSV export is available at any time, including in the read-only state, and is the reliable way to hold your own copy.

Some jurisdictions do not allow these limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.

12. Apple

These terms are between you and Pagani Enterprises LLC only — not Apple. Apple is not responsible for Keptcase or its content. Apple has no obligation to provide any maintenance or support for Keptcase. If Keptcase fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever. Apple is not responsible for addressing any claim relating to Keptcase, including product liability, regulatory compliance, or consumer protection claims, or any third-party claim that Keptcase infringes intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

13. Termination

You can stop using Keptcase at any time by cancelling your subscription and deleting the app. We may suspend or end your access if you materially breach these terms, in particular section 6. You can delete your account and all cloud data from Settings → Cloud Backup, which removes your backup, your photos, and your account from our servers.

14. Changes to these terms

We may update these terms as the app changes. When we do, we'll update the effective date at the top, and for material changes we'll give notice in the app or by other reasonable means. Continuing to use Keptcase after a change means you accept the updated terms.

15. Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Florida will have exclusive jurisdiction, except where the consumer-protection law of your place of residence gives you the right to bring proceedings elsewhere.
